By accepting a quote or engaging our services, you acknowledge and agree to these Terms of Trade. These terms ensure a clear understanding of expectations, responsibilities, and payment obligations between The Welder Limited and our clients.
• All estimates provided are indicative only and subject to change due to material costs, labour, or unforeseen circumstances.
• A 50% deposit is required before work commences. This secures your booking and covers material costs.
• The final invoice will reflect actual time, materials, and services provided.
• Any additional work outside the initial quote will be charged separately and must be approved before proceeding.
• Pricing may be adjusted due to fluctuations in material costs, labour rates, or other factors.
• Payment is due in full upon invoicing, unless prior arrangements are made in writing.
• If payment is not received within 7 days of the invoice date, a 10% late payment fee will be applied.
• An additional 10% penalty will apply every 7 days until full payment is received.
• The client is responsible for all costs associated with recovering overdue payments, including legal fees and debt collection costs.
• We reserve the right to cease work or withhold completion until full payment is received.
• Welding & fabrication: $150 + GST per hour (per labourer, if more than one is required).
• Minimum charge: All jobs under 1 hour will be charged a minimum of $150 + GST.
• Travel time: As a mobile service, return travel time is charged.
• Generator use: $40 + GST per hour (applies when power is unavailable).
• After-hours work: A one-off fee of $150 + GST applies for work starting after 5:00 PM.
• Emergency call-out: A flat fee of $250 + GST applies.
• PS3 Certification: If a Producer Statement 3 (PS3) is requested after invoicing, an additional charge of 0.25 hours will apply. The document will be issued only after payment is received.
• The Welder Limited guarantees workmanship for 12 months from the date of completion, excluding normal wear and tear, misuse, or third-party modifications.
• We are not liable for damage caused by improper use, poor maintenance, or third-party interference.
• Clients must ensure safe site access during the project. Any delays caused by access issues may be chargeable.
• Any modifications or repairs performed by unauthorized third parties will void our warranty.
• Cancellations must be made at least 48 hours before the scheduled work begins to avoid a cancellation fee.
• A 25% cancellation fee applies if cancellation occurs within 48 hours of the scheduled start time.
• Rescheduling requests are subject to availability and may incur additional charges.
• All materials remain the property of The Welder Limited until full payment is received.
• We reserve the right to reclaim materials or remove completed work if payment is not received in full.
The Welder Limited is not liable for delays or failure to perform work due to circumstances beyond our control, including but not limited to:
• Severe Weather Conditions:
• Heavy rain, storms, or flooding creating electrical hazards or unsafe working conditions.
• Extreme heat exceeding 42°C, where working conditions become hazardous to health and safety.
• High winds that compromise structural safety or increase fire risks.
• Freezing conditions, ice, or snow, making handling metal and welding dangerous.
• Other Unforeseen Circumstances:
• Natural disasters such as earthquakes, wildfires, or cyclones.
• Supply chain disruptions affecting material availability.
• Industrial actions (strikes or protests) preventing work access.
• Mechanical or equipment failures beyond our control.
Rescheduling Due to Force Majeure:
• If work is delayed due to any of the above, we will notify the client and reschedule the job at the earliest safe and practical opportunity.
• Any rescheduling or additional costs caused by these factors will be discussed with the client in advance.
• If an invoice remains unpaid and is referred to a debt collection agency or legal process, the client agrees that:
• All collection costs, legal fees, and administrative charges will be added to the total outstanding balance.
• The client is fully responsible for these additional charges.
• In the event of a dispute, both parties agree to attempt resolution through negotiation in good faith.
• If a resolution cannot be reached, the dispute will be referred to mediation before legal action is taken.
QUOTING & SITE VISIT FEES
• Site visits and consultations that require travel and assessment may be subject to a fee, depending on location and complexity.
• Our standard quote/site visit fee is:
• Local site visits (within 25 km): $140+ GST
• Extended site visits (25km up to 75km): $160 + GST, plus travel at $1.50/km
• Further trips (above 75km) will be charged $150 per hour , plus travel at $1.50/km
• Complex assessments (requiring significant planning or design input): Charged at our hourly rate of $150 + GST per hour.
• If the client proceeds with the quoted work, we may waive or credit the site visit fee toward the final invoice.
• This fee applies to ensure that our time, expertise, and travel costs are covered.
